Mugodhi Church Leadership Wrangle: High Court Dismisses Sigauke’s Application

A High Court judge has dismissed an application by Mugodhi Apostolic Faith Church that was filed by Tony Sigauke which sought to dethrone Washington Mugodhi as the Bishop of the institution.

Washington is being accused of imposing himself as the bishop of the church against a court order.

In the application, Washington was cited as the respondent while Mugodhi Apostolic Faith Church is the applicant.

In a founding affidavit that was filed along with the application, Tony Sigauke, who is the deponent, indicated that he wants Washington’s appointment as bishop of the applicant to be declared null and void. He wants Aaron Munodawafa to be declared the substantive bishop whilst he is declared the acting bishop of the applicant.

In her judgement, Justice Easter Muremba said Sigauke has to show that he was properly authorised by the applicant to represent it in legal proceedings.

“This resolution in question is an extract of the minutes of the National General conference held on 2 February 2020… It says nothing about the applicant being authorized to institute legal proceedings against the respondent… It also does not say that the deponent was authorised to represent the applicant in legal proceedings.”
“It is interesting to note that a declarator for the appointment of Aaron Munodawafa as the bishop of the applicant is being sought yet Aaron Munodawafa is not an applicant in the matter. A relief which affects him cannot be sought in his favour without him being part of the proceedings,” read part of the judgement.

Justice Muremba said “it is clear from the founding affidavit that Tony Sigauke, the deponent, has a personal interest in the matter.”

“In view of the foregoing, I make a finding that the applicant has no locus standi to bring the present application. In the result, it is ordered that the application is dismissed.”

Sometime in February 2019, the late Bishop Tadewu Mugodhi was diagnosed with a terminal illness leading to his death in October 2019.

When he was sick, Mugodhi pronounced his son Washington as the bishop during a meeting.

However, Sigauke said this was unlawful and proceeded to approach the courts challenging the move.
